These Terms of Service ("Terms") govern your access and use of our mobile application Food Calorie Counter - AI Diet ("App"), and all services provided through them (collectively, the "Services"). By using the Services, you agree to these Terms, forming a legal agreement between you ("user" or "you") and SophosAI ("Company," "we," "us," or "our").

If you do not agree to these Terms, please do not use the Site, App, or Services.

3. Dispute Resolution & Arbitration 

By using our Services, you agree that legal claims must be resolved via binding arbitration (unless you opt out within 30 days). This means:

• You waive your right to sue in court (except small claims court).

• You may not join class-action lawsuits.

• Arbitration will be handled under American Arbitration Association (AAA) rules.

4. Eligibility 

To use the Services, you must:

5. User Conduct

8. App Store Terms 

If using our App via third-party platforms (e.g., App Store, Google Play), their terms also apply. In case of conflict, the stricter terms apply.

9. Payments & Subscriptions 

Some Services offer paid features. Payments are processed by app stores. Subscription terms, renewals, and cancellations must be managed through your store account. Uninstalling the App does not cancel subscriptions.

We may link to third-party websites. We are not responsible for their terms, practices, or content.

11. Legal Disputes 

Before taking legal steps, contact us at [email protected]. If unresolved after 30 days, disputes will be handled via binding arbitration. Exceptions:

• Either party may use small claims court if applicable.

• Arbitration does not allow class actions.

• Arbitration can be opted out of within 30 days of initial use.

• If arbitration is not enforceable, disputes fall under California jurisdiction.

12. Disclaimers & Limitation of Liability 

Services are provided "as is." We do not guarantee error-free, uninterrupted service. We are not liable for:

• Errors or outages.

• Data loss or damages.

• Indirect losses exceeding $50.

These Terms are governed by California law. The UN Convention on Contracts for the International Sale of Goods does not apply.
