Effective Date: May 13, 2025
Our Privacy Policy explains how Food Calorie Counter - AI Diet ("we," "us," or "our"), the developer of this mobile app ("the App"), gathers your information when you use it. This policy also details how we use and share this information and outlines your related rights.
To ensure the App's features work correctly, it asks for certain sensitive permissions. Access to Photos/Media/Files, Storage, and other permissions is only used to improve, edit, or save your photos or media within the application.
Regarding Photos/Media/Files, the App only accesses files you specifically choose for editing or enhancement and never automatically accesses your media without your permission.
The app's food logging feature, which uses your device's camera, requires camera access. This allows you to photograph your meals for calorie tracking and nutritional analysis. The App uses these photos to identify and log your food. You can control and withdraw camera access through your device settings at any time. By using this feature, you agree to the handling of these images as described in our Privacy Policy.
We guarantee that any user data obtained through these permissions will not be shared or given to others without your explicit agreement, unless legally required. We are committed to protecting your privacy and data security and follow all relevant data protection laws. More details about our Privacy Policy can be found in the sections below.
1. Your Agreement: Think of this Privacy Policy as the terms of service, but for your data. By using or accessing our App, you're saying "yes" to how we collect, store, use, and share your information, as we explain in the following sections. If anything in this policy doesn't sit right with you, then please don't use our Service.
2. Staying Updated: We might tweak this Privacy Policy from time to time. We'll let you know about any changes by posting the updated version in the App or by sending you an email. If you keep using the App after these changes are live, it means you're on board with the new policy. The "Last Modified" date at the top will always tell you when we last made changes. If you don't agree with the updates, you should stop using the App right away.
We might also give you little pop-up notices or extra info about how certain parts of the App collect, use, and share your data right when you're using those features. These can give you more insight into our privacy practices or offer you more choices about how we handle your data.
3. What Information We Gather:
A. Cookies and Similar Tech: We use these little helpers to understand how you interact with our App and to show you ads that might be relevant to you. For example, we track which features you use, how long you spend on certain screens, and if you run into any errors. Check out the privacy policies of any third-party services we use for more details.
B. Your Health and Fitness Data: To make your experience better and help you smash your fitness goals, we might process your health and fitness information. This data is essential for the App's core functions and is collected accordingly. This isn't temporary data; we need it for the App to work properly.
C. Your Device Details: We collect information about the device you're using to access our App. This could include the type of device (phone, car system, etc.), your advertising ID, your network connection (Wi-Fi, cellular, etc.), your operating system and version, your language settings, and your mobile carrier.
D. Media from Other Sources: Sometimes, we might get media-related information about you from other apps or services connected to our App. For instance, if you sign up using your Facebook or Google account, we might receive certain information depending on your privacy settings there. We use this to create your account with us. We might also share your data with social media or ad platforms so you and others see relevant ads. For example, we might use Facebook Custom Audiences to show you targeted ads or create groups of similar users. You can usually control these settings in your social media account's privacy options.
E. Permissions We Might Ask For:
Photos/Media/Files permission: We only access the specific files you choose to enhance or edit. We'll never automatically look through your media without your explicit permission. We promise that any data we get through this permission won't be shared unless you specifically say it's okay, or if the law requires it. Your privacy and data security are a big deal to us, and we follow all the relevant data protection rules.
F. Other Bits of Information:
We also collect things like your age, gender, weight, height, fitness level, and goals. This helps us make the App better and gives us insights for creating personalized experiences, especially when it comes to tailoring diet plans to your unique needs. This data isn't temporary; we need it for the App to work as intended. You can find all the details about the specific personal data we collect in the relevant sections of this policy or in the explanations we show you before we collect the data.
- A Note About Your Sensitive Health Information:
We understand that your health information is personal and sensitive. We'll handle it with care and in line with all relevant privacy laws. We don't sell your health information or share it with other companies without your permission. Please remember that any health information you add to the App is sensitive. While we take steps to protect it as required by law, it might still be accessed if the law demands it.
4. Information We Generate When You Use Our Services:
Think of it this way: when you interact with AI Diet, we pay attention to how you do it – what features you enjoy, how often you use them, and even the content you create. This isn't about spying; it's about understanding how our community uses the App so we can make it even better, smoother, and more tailored to you.
This includes things like the filters you browse and apply, the food diaries you check out, and how frequently you log your meals. It also involves the content you share (photos, descriptions, etc.), how you use our camera tools, and even your interactions within any built-in games – like when you posted something and who viewed it.
To help us with this, we also look at your general location (based on your internet address), information from cookies and similar tech (depending on your settings), and activity logs. These logs tell us things like when you access the App, which screens you visit, your internet address, and unique identifiers that help us recognize your device.
5. Putting Your Information to Work:
The insights we gain from how you use AI Diet help us understand what's working and what could be improved across all our products and services. We promise to only use your personal information in the ways we describe in this Privacy Policy or that we clearly explain to you before we do anything with it.
If you ever feel like we're using your information in a way that doesn't align with the original reason we collected it or what you later agreed to, you have the power to tell us to stop. However, keep in mind that limiting how we can use your information might mean that some parts of the App won't function as they should.
Here's a breakdown of how we use your data:
A. Showing You Relevant Stuff (Advertising): Sometimes, we use your data to show you ads within the App (like banners) that we think you might be interested in. Don't worry, not all your personal data is used for this! The details and conditions for this are below. Some of the services we use for this might use cookies to recognize you or something called "behavioral retargeting," which means showing you ads based on your interests even when you're on other websites. For the nitty-gritty details, check out their privacy policies. You can usually opt out of these types of ads through the Network Advertising Initiative website, in addition to any options these specific services offer.
Partners: MoPub (MoPub Inc.), Admob (Google LLC), Facebook Audience Network (Facebook, Inc.)
What they might collect: Cookies, Usage Data.
B. Understanding How the App is Used (Analytics): These tools help us see how people navigate our App and can tell us about user behavior.
Our Own Analytics: We use our own system that doesn't involve sharing your data with other analytics companies.
What we might collect: Cookies, Usage Data.
Google Analytics for Firebase (Google LLC): This service helps us understand app usage. It might share data with other Google Firebase tools to help with things like crash reports and user authentication. You can read their privacy policy for all the details. We use unique identifiers for mobile devices to make this service work. You can often control some of these features in your phone's settings (like ad settings) or by following instructions elsewhere in this policy.
What they might collect: App opens, App updates, device info, first launches, general location, number of sessions and users, operating systems, how long you use the app, Usage Data.
C. Keeping the App Running Smoothly (Infrastructure Monitoring): These services help us watch how all the different parts of the App are working so we can improve performance, fix bugs, and keep everything running smoothly. The specific data they look at depends on how they're set up.
Partner: Crashlytics (Google LLC)
What they might collect: General location, unique advertising IDs for your device, other data as described in their privacy policy.
D. Powering the App (Hosting and Backend): These are the services that store the data and files that make the App work and allow us to distribute it to you. Some of these services use servers in different parts of the world, so it's not always easy to know exactly where your data is stored.
Partner: Amazon Web Services (AWS) (Amazon Web Services, Inc.)
What they might collect: Various types of Data as described in their privacy policy.
For Legal Reasons: We might also need to use your personal data if there's a legal issue, like a court case, or if we're preparing for potential legal action related to misuse of the App or our services.
6. Keeping Your Data Under Lock and Key: We use standard security measures to try and protect your information from being lost, used incorrectly, or changed while it's in our hands. However, the internet isn't a completely secure place, so we can't 100% guarantee the safety of any information you send to or through our App. You do so knowing there's a level of risk involved.
7. Where Your Data Might Travel: If you decide to use our App or give us your information, it might end up being sent to and stored on servers or databases in countries outside of where you live, including the United States. The data protection laws in those countries might not be as strict as the laws in your own country. If you're not comfortable with your information being sent to, processed, or stored outside of your region, please don't use our App.
If you live in Europe (EEA), the UK, or Switzerland, there's some specific information just for you in Section 16 below.
8. Meet Our Data Protector (DPO): We have a Data Protection Officer, Sarah Sun, who makes sure we're handling your data responsibly and following all the rules. You can reach Sarah at [email protected] if you have any questions or concerns about how we're looking after your personal information.
9. Your Choices About How We Use Your Data (Opt-Out Rights): You have the right to tell us to stop: (i) showing you targeted ads, (ii) selling your personal data, and/or (iii) making important decisions about you based on automated profiling. If you want to exercise any of these rights, just email us at [email protected]. We'll get back to you within the timeframe required by the Virginia Consumer Data Protection Act (VCDPA). We might need to ask for a little more info to make sure it's really you making the request. You can find more details in Appendices A and B.
10. Your California Privacy Rights (CPRA): If you're a California resident, you have specific rights under the CPRA. You can ask to see, correct, or delete your data, and you can also know if we're selling or sharing your data and with whom. To use these rights, email us at [email protected]. We'll respond within the CPRA timeframe. We might need to verify your identity first. You also have the right to know if we share your data with other companies and what types of companies. Again, email us at [email protected], and we'll respond according to the CPRA, possibly needing to confirm your identity. If you live in California or another state with similar privacy laws, you can also ask if we sell your data, what types of data we sell, and who we sell it to. You also have the right to tell us not to sell your data. Contact us at [email protected], and we'll respond as required by law, possibly needing to confirm your identity. Check out Appendices A and B for more info.
11. Your Virginia Privacy Rights (VCDPA): If you're a Virginia resident, the VCDPA gives you rights to see, delete, and correct any inaccurate personal data we have about you. To use these rights, contact us at [email protected]. We'll respond within the VCDPA timeframe and might need to confirm your identity.
12. Links to Other Sites: Our App might have links to other websites or social media. We don't control how those sites collect, use, or protect your data, so please read their privacy policies carefully to understand their practices. We also use small software tools called SDKs from other companies to help our App run smoothly and reliably. We carefully check these companies and their SDKs to keep your data safe. The list of SDKs we use is below:
13. "Do Not Track" Signals:
You might be able to turn on a "Do Not Track" setting in your web browser to tell websites you don't want them to track you. However, our system doesn't currently respond to these "Do Not Track" signals.
14. How Long We Keep Your Information:
We hold onto your information only as long as we need it for the reasons explained in this Privacy Policy. This includes providing you with our Services and for other legitimate purposes, such as following legal requirements, enforcing our rules, preventing spam, and protecting our rights, property, and users. How long we keep your information depends on a few things, which we look at individually for each situation:
What kind of information it is and why we collected it: Generally, we'll keep your information as long as it's necessary to provide you with the Services you use, including any extra features, and to help you if you need customer support.
Legal reasons: Sometimes, we have to keep your information for longer because the law requires it, as described in the "Legal Reasons" section below. This can even be after you've closed your account.
Specific Legal Obligations: We keep your information to respond to official legal requests or to follow applicable laws when we have a legal duty to retain it. For example, if we get a valid legal request like a court order related to your account, we'll keep your information even after you delete your account.
Handling Issues and Complaints: We keep records of requests and complaints, usually for a year after they're closed, in case there are further issues or we need this information to handle any follow-up complaints. If there are ongoing complaints, we'll keep the records until they are resolved.
Legal Disputes and Regulatory Matters: If there's a legal claim, complaint, or regulatory investigation, we'll keep your information if it's reasonably necessary. This could be if we're being investigated or if we need to defend ourselves in a lawsuit related to your information or respond to a regulatory body about a complaint you or someone else made.
Maintaining Safety, Security, and Integrity: We keep information when it's necessary to investigate misuse of our Services, like spam or other negative experiences. If we have to disable an account for breaking our rules, we'll also keep information about that user for safety and security reasons.
The specific information we keep and for how long depends on the particular reason we need to keep it.
Operational Needs: Sometimes we need to keep information for our own operational purposes. For instance, if a message can't be delivered right away, we'll keep it encrypted on our servers for up to 30 days while we try to deliver it. We also store information when it's needed to troubleshoot and fix problems with our Services, usually for up to 90 days, unless we need to keep it longer to investigate and resolve a specific issue or for legal reasons.·
15. Managing and Keeping Your Data:
We provide tools within the app, like the "Request Account Info" feature, that allow you to see or move your data.
We keep your information for as long as we need it to provide you with our services and for other valid reasons. These reasons include following legal rules, making sure our terms are followed, preventing misuse, and protecting ourselves and our users. How long we keep your data depends on the specifics of each situation, considering things like what kind of data it is, why we collected and use it, if there are legal or operational reasons to keep it, and what the law requires.
If you want more control over your information – to manage it, change it, limit how we use it, or delete it – you can use the following:
Service Settings: You can adjust your settings within the Services to control some of the information that's visible to other users.
16. Deleting Your Data:
When you close your account, or if it's closed because you haven't used it for a while, we will immediately delete the information we have about you.
17. For Our California Users:
California law gives residents the right to ask us once a year, for free, for a list of the categories of personal information we shared with other companies (including our own related companies) for their direct marketing purposes in the previous year. If you're a California resident and want to request this notice, please contact us using the details in the "How to Contact Us" section and mention that you're requesting a "California Privacy Rights Notice." Please allow at least a month for us to get back to you.
Please note that we don't have to delete content or information if:
Other state or federal laws say we or another party has to keep it.
Another user posted, saved, or shared that content or information.
The information has been made anonymous so it can't identify the individual.
The individual doesn't follow the instructions in this Privacy Policy for requesting removal.
The individual received something of value for providing the content.
Also, nothing in this section limits law enforcement's ability to get this kind of content or information.
18. Important Information for People in Europe, Switzerland, and the UK:
This section applies specifically to people who access or use our Service while they are in the European Economic Area, Switzerland, and/or the United Kingdom when we collect their data. We might ask you to tell us which country you're in when you use some of our Services, or we might use your IP address to figure it out.
If you hide your location so you don't appear to be in these countries, this section won't apply to you. If any part of this section disagrees with other parts of this Policy, then the terms in this section will apply to users in these specific countries.
A. How We Relate to You: Food Calorie Counter - AI Diet is the "data controller" for any personal information we collect from people in these countries who use our Service. A data controller decides why and how personal information is processed. Any other companies that provide services for us or act on our behalf are "data processors" and handle your personal information according to our instructions.
B. Our Legal Reasons for Using Your Information: We explain our legal reasons for using your information throughout this Policy. Here's a summary of the reasons and the corresponding legal grounds:
You've given us your permission for one or more specific reasons.
We need to use your data to fulfill an agreement with you or to take steps before entering into an agreement.
We have a legal obligation to process your data.
Processing your data is necessary for a task in the public interest or because we have official authority.
Processing your data is in our legitimate interests or the legitimate interests of a third party.
We're happy to explain the specific legal reason we're using your data in any case, especially whether you're required to provide the data by law or contract, or if it's necessary to enter into a contract with us.
C. Your Rights: When you use our Service, you have the rights described below. If you want to use your rights under the applicable laws, please contact us at [email protected]. To protect your personal information, we might need to verify your identity when you make a request.
Right to Take Back Your Consent: If we ever asked for your permission to use your personal information, you can change your mind and withdraw your consent at any time. Withdrawing your consent won't make it illegal for us or any third parties to have processed your data based on your consent before you withdrew it.
Right to See Your Data: If you ask, we'll give you a copy of your personal information that we have, without undue delay and for free, unless the law allows us to charge a fee. We might limit what you can see if it would negatively affect the rights and freedoms of other people.
Right to Fix Your Data: You can ask us to correct or update any personal information we have that's wrong. Sometimes, you can update your information directly through the Services.
Right to Erase Your Data ("Right to be Forgotten"): If you ask, we'll erase your personal information if: it's no longer needed for the reasons we collected or used it; you gave us permission to use it, but then you withdrew your consent; or you object to how we're using it, and we don't have any overriding legitimate reasons to keep processing it.
Right to Limit How We Use Your Data: You have the right to restrict how we process your personal information in certain situations. While processing is restricted, we'll only process your data if we have your consent, if it's necessary for legal claims, to protect someone else's rights, or for important public interest reasons. We'll let you know if and when the restriction is lifted.
Right to Object: You can object to our processing of your personal information at any time if we're using it based on consent, a contract, or our legitimate interests, as allowed by law. We might still process your data if it's necessary for legal claims or for other reasons permitted by law.
Right to Data Portability: If we're processing your personal information based on a contract with you or your consent, and we're doing it automatically, you can ask to receive your data in a common, machine-readable format so you can give it to someone else. We can also try to send it directly to another "controller" if it's technically possible and doesn't negatively affect other people's rights. This right only applies to the personal information you gave us.
Telling Others About Your Requests: When we correct, erase, or restrict the processing of your personal information based on your request, we'll also tell any other companies who are handling that data, unless it's impossible or would involve too much effort. We'll also tell you who those companies are if you ask.
Decisions Made Automatically (Including Profiling): You have the right not to be subject to a decision that's based only on the automatic processing of your personal information, including profiling, if it has a legal or similarly significant impact on you, unless there's a legal exception.
Limits to Your Rights: We might have to limit your requests to exercise these rights in certain situations, such as if the law requires or allows us to deny access, if giving access would harm someone else's privacy, to protect our own rights and property, or if your request is unreasonable.
Transferring Your Personal Information: We transfer your personal information with appropriate safeguards as allowed by data protection laws. When we transfer your data out of these designated countries, we have the necessary contractual agreements in place with the third parties receiving your information. For these transfers, we rely on legal mechanisms like Standard Contractual Clauses or work with U.S.-based companies certified under the EU-U.S. and Swiss-U.S. Privacy Shield Framework.
Right to Complain: If you think we've violated your privacy rights under the applicable laws or this Policy, please contact us at [email protected] so we can try to resolve your concerns. You also have the right to file a complaint with the relevant authority in the country where you live, work, or where you believe the violation occurred.
